the gunman arrested today in an active shooter situation in oakland has died at the hospital after he was shot by a police sniper. >> the man appeared to be alert when he was taken away in an ambulance this morning. but our sources say the sniper's bullet hit him in the shoulder and then sent fragments throughout his upper body. good evening everyone i'm frank somerville. >> i'm julie haener. it was a bizarre incident. a typically quiet neighborhood. a man started firing off enter state 580 at golf links road. bishop high school is just around the corner and the oakland zoo is only a few blocks away. >> police say the suspect also took shots of officers responding to the area and he was spotted with a can of spray paint drawing crude graffiti on his neighbor's garage and on a car. >> the suspect was identified as 22-year-old jesse enjaian. according to his facebook page, enjaian was a computer science

engineer who attended ucla and the university of michigan law school. >> enjaian was known to have a hostile relationship with some of his black neighbors and had been known to use the n word. our crime reporter henry lee was on the scene almost from the beginning. >> reporter: oakland police -- the call to oakland police came in after 9:00 this morning. a woman called 911 saying her next door neighbor was firing shots, but it wasn't from some ordinary handgun. >> a shooter, this was a male described to have a long rifle with a scope. he was reported shooting in the area 9500 block of las vegas. it was reported the shots were fired at residents. some of the cars parked on the streets as well. oakland officers responded immediately. when they arrived on scene, this individual started shooting in their direction. >> reporter: police returned

fire. >> the suspect disappeared back into the residence. >> it was a guy with a gun. i was scared, so i stayed inside and locked my house down. >> reporter: as the active shooter situation was unholding, nearby high schools were placed on lockdowns. on and off ramps at 98th avenue was closed by chp. during the incident, sky fox shot this video of what appears to be lewd images spray painted by the suspect on a nearby home. after for an hour, officers were able to arrest the suspect 32-year-old jesse enjaian outside the home. his rifle with the scope was recovered. sources say he was shot in the ankle and shoulder by an oakland police sniper. he was taken to the hospital by ambulance. a motive is not yet clear, but

i have learned from police sources that the suspect has been involved in ongoing disputes with his neighbors. neighbors also tell us some of these arguments are racially motivated. the suspect has used racial tones towards some of his neighbors who are african american. in oakland henry lee ktvu fox 2 news. >> officers checked out the prior reports of homes being shot at, but doesn't appear any action was taken. one woman who didn't want to appear on camera today said she was with her 6-year-old son when bullets started flying right through their home. >> absolutely. we sheltered in place under his bed in his bedroom and i was very concerned because i have windows all around my home and i did not know where the shooter was. >> a neighbor says she knew she wasn't the only one the shooter targeted. he also said it would be difficult for her and her son to return home tonight. new at 10:00 a problem in livermore at the post office. the lobby is left open 24/7 for

people to retrieve mail. but recently the homeless has started to move in at night. ktvu rob malcolm is live where they will start planning to lock doors after 9:00 p.m. rob? >> reporter: right now, julie, we are open at the post office. they don't know what is happening inside. those changes could happen at the end of the month. getting mail here on livermore avenue has chris wells bumping into the overnight guests. many are homeless. >> there's a couple of people i have seen, a lady is in a wheelchair. another lady is in here late at night. doesn't seem to be a problem for me when i get my mail. she wants some place warm, you know, that's the bottom line. >> reporter: others have the same idea. over the past year the lobby of this post office has been used by the homeless as a makeshift shelter. sleeping here tonight.

>> and there is no place out here in livermore for me to go. >> reporter: while anthony sleeps, customers like tonya stevens worries about what some are leaving behind. >> they make a mess in the lobby. there is urine in there and puke. they have men in there who have their zippers down with their hands in their pants. >> i have come in late. and is it a problem? it's cold out, you know, people need a place to stay. so for me i understand it. >> reporter: the tri-valley has six shelters in place and the director of the tri-valley. >> we could probably have ten of them here. we have a food pantry and to provide blankets, water, food. >> reporter: in 2014 the city of livermore held a crisis on

the housing market. they started to solve those problems, the postmaster would close the lobby from 9:00 p.m. to 5:00 p.m. daily. with the closure eminent, there is a crisis of his own. >> i know it will be closed and it will be closed down. the thing of it now, i don't know. i don't know where to go. because there is no place to go. >> very sad story. now the lobby on the post office has been open 24/7 for the past 20 years. the city of livermore is looking for state and federal funding to create more affordable housing. >> it is is sad for people like anthony who -- it is sad for people like anthony who don't know where they will go. have they noticed a big increase in the homeless population out there? >> we have numbers in 2015 staying in alameda county alone with 24,000 people. now they will be seeing those numbers grow up over the past

several months. >> rob malcolm in livermore tonight, thanks, rob. we are still seeing scattered showers over the bay area this hour after a day of rain. tomorrow though we should get a break before yet another storm moves in. this is a live look from our cameras on sutro tower in san francisco. >> today's rain came with winds, knocking down trees, taking some of the power lines too, having to dump water as quickly as they can to make room for more runoff. >> reporter: a chain saw crew had to tackle this large tree, which uprooted on the avenue. fortunately no one was injured. the tree fell directly on the car as one woman was having coffee with her mom when she thought it was thunder and that is when she looked out the window. >> you don't expect to see a tree laying there and they were going off underneath the tree. >> and chief meteorologist bill martin is here now with more rain on the saturated soil as

it doesn't look like they would get much of a break. >> that's what's important. tomorrow will be a pretty long day of a break and then more rain wants to show up on sunday night. so yeah it would be nice to get more like what we had last week. we're basically looking at the rainfall out there today. ben loman is coming up over two inches in guerneville. these are your totals that came in at two inches. then you look at these numbers of santa rosa, .67 -- .67 in concord. scattered showers. let's take a look at most of the showers moving off the east now. mostly the heavier stuff is towards brentwood and antioch and fairfield, still raining hard out there towards live mother valley and out by san jose -- livermore valley and out by san jose. heavier rain showers are moving through. when i come back, we will talk about tomorrow as we do have significant breaks going into tomorrow and sunday. but the changes will be halfway through the day on sunday. i'll see you back here.

today's storm has caused power outages around the bay area when we last checked with pg&e there were more than 17,000 customers affected. most of the outages of 12,000 are in the south bay. nearly 4,000 pg&e customers are without power in the east bay. in the north bay more than a thousand customers are said to be without electricity at this hour. in less than ten minutes, two cars swallowed by a sink hole. the rescue operation underway tonight in southern california. new at 10:00, transit administration has delayed a decision on a multi-million dollar grant needed to keep california's high-speed rail project on track. the $650 million federal grant would help pay for the electrify casing of cal -- rectification of caltrans. they need to electrify the line if they will run their service in san francisco. california republicans had asked the transportation department to block approval of the grant until an audit of the bullet finances is completed.

caltrans executive director jim hartnet vows to continue the fight saying electrification is the greatest that this corridor has ever taken, offering unique environmental benefits. >> the environmental protection agency will have a new leader tonight. but the environmentalists say he is unfit to serve. former general confirmed today and swore in democrats. >> jana katsuyama is here with the controversy surrounding the new director of the epa. >> reporter: we are seeing a lot of controversy. scott pruitt faces massive democrats and activists and the environmental scientists who would sign the petition opposing the confirmation. but the republicans said he would help ring in the agency, which he says takes power away from the states.

a man who spent years suing the epa, taking the top spot in the epa. >> they are 54 and the nays are 46. the motion is agreed to. >> the senate republicans and the two democrats voted for pruitt while the environmentalists and the senate democrats held an all- out, all-night effort to delay the vote. and some who donated to his political campaigns. the sierra club and other opponents of the 48-year-old republican say he spent six years as attorney general of oklahoma during which he expressed some doubt about global warming. in his confirmation hearing, he would adhere to the rule of law. >> and regulators are suppose to make things regular to fairly and enforce their rules, not pick winners or losers. >> reporter: pruitt filed 14

lawsuits against the epa. >> some of those lawsuits are still out there. >> dan farber says his lawsuits challenge epa regulations on epa emission and waste water clean up. pruitt won't be able to change the law. >> they view it as nothing, but a burden to the economy. they don't think that it is serving any useful purpose. >> reporter: pruitt will have power to make enforcement changes. >> he could just decide we're not going to bring in enforcement actions. he can cut back on the size of the enforcement division that would happen before. and to the point where really they are just not in a position to really, you know, be out there enforcing the law. >> reporter: shortly after the confirmation they posted this message on twitter saying they would like to congratulate mr. pruitt. we look forward to welcoming

i mean there is no intention stated, it is anybody's guess. >> they will make a lot of people happy, thank you. with more rain on the horizon, they are continuing to monitor the safety of the spillways. so crews could remove the debris that will be piled up at a nearby electric plant. the department of water resources says that the level is now 44 feet below the lip of the emergency spillway. they are confident they have created enough room to handle the runoff for the next series of storms. today's storm hits southern california especially hard. they issued a flash flood warning toppling many trees. in studio tonight, a large sink hole opened up. two vehicles fell into it. in this video you can see the crews working to get those cars out.

taking the scene away as they will bring in bill martin now for more of aspective. >> yes, it is rain. we are getting rain and we had rain, i showed you that. but they are getting the brunt of this storm. look at the rainfall for southern california. as you look at this half a foot in ventura, half a foot in santa barbara and they would recognize santa barbara and los angeles, they don't really have those rivers. they don't have a set up to get rid of all those waters. the rain is still hammering from malibu up south. what i did, i pulled up the storm reports just to show you. these are the ground ob receiver advances. there is a debris flow in fraser park and the back. here is the 80 miles an hour wind gust. long beach, the airport there they are having to delay 75 miles an hour winds. and let's see what will be out here. we've got some non-storm wind damage and some 65 miles an

new at 10:00, animal control is asking for help in getting dozens of rabbits adopted. a man was selling rabbits illegally. ktvu amber lee is live in the city after learning about this rescue operation. amber? >> reporter: julie, police received a tip from someone who said this man posted rabbits on craigslist offering them for pets or to eat. these rabbits are among the 40 impounded from a man selling them out of his garage. they are now being cared for by save a bunny in mill valley and in foster homes. >> these guys are probably no more than eight days old. >> reporter: it is a health code violation in san francisco to sell chickens or rabbits as pets or novelties. so she contacted the rabbit owner, saying she was

interested in buying the bunnies, learning he had dozens. >> i wanted to get a sense of his operation. my sense was i needed to contact animal control and care as soon as possible. >> reporter: a number of rabbits being sold as meat has increased dramatically in the past four years. there is a push to make them a part of specialty cuisine. >> instead of doing say one rescue rabbits per year we are doing four large scale ones in several smaller scale ones. so it is a big deal. >> reporter: animal control and officials say the owner of these rabbits would willingly surrender the animals. when they declined to release details of this case, normally it is a misdemeanor for each animal, but a fine for each count. >> this is an ongoing investigation as we will be checking in with the individual to make sure they're in compliance with everything we asked. >> reporter: the owner will no longer be allowed to have rabbits. but the majority of the rabbits

the latest storm causes problems in santa cruz county, where crews scrambled to clear down trees and power lines brought down by the wind and rain. >> ktvu jesse garrett with the problem that is making homeowners nervous. >> it happened at about 7:30 this morning and i heard the big crash. >> reporter: julie says her neighbor on the other side of park avenue recently purchased this home. today the first homeowner trial by tree after this massive tree caused damage to the house.

it is hear -- it is hazardous. there are trees falling that we can't get to at times or extended periods of times. >> the gentleman's house who was damaged wasn't hurt. he was on the other side of the dwelling when the tree came crashing down. a tree removal company showed up late today and they started a difficult task of trying to cut that problem down in size. san bernardino ktvu fox 2 news. so we are tracking the snow in the mountains. the snow is up there right now, seeing some issues on 80 and 50. the snow report just shows plenty of snow, actually a lot of snow winter weather advisory up there as we would head into tonight and tomorrow. a good ski weekend, but just, you know, be prepared on the roadways. here is what we're tracking right now. you can see this system right here, they want to come in for early next week. this is a significant sunday that will be wet. right now we're seeing strong rain down through southern california and strong winds too. these stronger winds in that area.

i we worked with pg&eof to save energy because wenie. wanted to help the school. they would put these signs on the door to let the teacher know you didn't cut off the light. the teachers, they would call us the energy patrol. so they would be like, here they come, turn off your lights! those three young ladies were teaching the whole school about energy efficiency. we actually saved $50,000. and that's just one school, two semesters, three girls. together, we're building a better california.
